The Yaounde Court of First Instance, has placed Cyrille Wandja Mbanya, husband of renowned Cameroonian actress and model, Nsang Dilong, in detention for alleged fraud, extortion and breach of trust.
The remand order was passed Tuesday June 8, 2021 by the Presiding judge of the Court of First Instance, Mengue Bikoro Onguene, after over four (4) hours of hearing.
The accused, Cyrille Wandja Mbanya, is charged with Fraud and Breach of Trust in a case of nearly FCFA 39 million brought to court by the plaintiff, Dr Erise Mary Dinga, a Douala-based ordained Apostle/Prophet and Founder/General Overseer of Real Worship and Gospel Center International.
Tuesday’s hearing was opened to debates with examinations and Cross examination of the plaintiff and his witnesses. The accused it should be noted had pleaded not guilty of the charges levied on him.
According to the plaintiff, she was approached by Mr. Mbanya, who presented a promising hemodialysis project to create a dialysis center in Bonaberie, Douala, which he was in search of financial partners because he had already invested FCFA 100 million and was short of funds to carry on.
It was the importance of the project to Cameroonians in general and kidney patients in particular and the trust for Mr. Mbanya, that pushed her, Erise Mary, to invest the said amount of FCFA 39 million.
She told the court that the said amount was handed to Mbanya in four different installments out of trust, based on the fact that he is a pastor and could not be suspected as one who could engage in dubious activities.
She declared haven parsonnally handed over the sum of FCFA 25 million as first installment to him, in the presence of her personal assistant, as custom dues for 15 hemodialysis machines that were already at the Douala Sea Port. FCFA 4 million was to rent an office space for the project paid to him by the manager of her company, FCFA 8 million for bank account/paper works at the level at Prime Minister’s office which she handed to him herself and FCFA 2 million for money to hire a truck to transport the equipment which was handed to him by her Personal Assistant.
Responding to questions from the State Counsel, the plaintiff, Erise Mary Dinga, declared that the deal became fishy when the accused, Cyrille Wandja Mbanya, demanded for an additional FCFA 50 million for other machines that would be needed in the project.
That is when she started asking petinnent questions and would only realize that she had invested her money in a project whose realization is not in any way possible as even machines for the project are no way by sight.
She then approached Pastor Mbanya, declining interest in continuing with in the project after noticing there was no developments.
Requests to get her money reimbursed are said to have met with stiff resistance from Mbanya, who she said at one point even categorically claimed not to have received a franc from her.
The hearing of Tuesday, June 8, 2021 unfolded under the eyes of the State Counsel, Onana Onana, in the presence of lawyers of the accused, Barristers Kamga Jean Jacques and Tangen Felix, and those of the plaintiff, Kamwa Denise and Gervais Armel Nang Mayi.
The defense lawyers during their cross examination tried to find out proves from the plaintiff on the exact nature of the deal and between her and their client basing their arguments that traces of the said financial transactions are not visible.
But the lawyers of the plaintiff presented to the court a document containing exhibits ranging from conversations and declarations on how the project was unfolding.
The presiding judge, Mengue Bikoro Onguene, after listening to both parties decided to demand the accused in custody following the severity of the case file as she mentioned, and then adjourned the case until June 22, 2021 to continue with the debates.
